This website was established by Class Counsel to provide information on the Proposed Class Action Settlement. The site is intended to provide legal advice to our clients, the people eligible for benefits in this Settlement. If the Proposed Settlement becomes final, it will resolve claims made on behalf of certain individuals who paid increased mortgage insurance premiums for insurance issued by Republic Mortgage Insurance Company due to information in a consumer report.
The lawsuit does not allege that Republic Mortgage Insurance Company overcharged anyone for mortgage insurance or that the premiums charged were illegal. The lawsuit alleges that Republic Mortgage Insurance Company violated the Fair Credit Reporting Act by failing to provide consumers with adverse action notice when it charged a higher rate for mortgage insurance based in whole or in part on information in a consumer report. This settlement represents a compromise of disputed claims and is not an admission of wrongdoing by Republic Mortgage Insurance Company.
The United States District Court has preliminarily approved the Proposed Class Action Settlement. You may be a member of the class if, from March 15, 2002 through December 31, 2006, you had a mortgage insurance loan insured by borrower-paid mortgage insurance in Republic Mortgage Insurance Company’s A-Minus Program, and if your credit report was reported to Republic Mortgage Insurance Company as 619 or less.
If you received a mailed Notice of Pendency of Class Action, Proposed Settlement, and Court Approval Hearing, you have been identified through Republic Mortgage Insurance Company’s records as a member of the class.
